Consultation on NCSS Act Amendments

As part of our move towards becoming Sector Developer for the social service sector, our role will extend beyond a membership body. We therefore need to update our NCSS Act, which currently characterises our role primarily as such. This will ensure that the Act remains fit for purpose, so that NCSS can effectively shape the sector to meet the challenges in the future.


We have consulted 302 members over 6 sessions, including more intimate discussions with 80 members in small focus group discussions.


The following summarises the key feedback received on the proposed amendments to the NCSS Act:


NCSS Objects/Functions

  • Members were generally supportive of NCSS’ move towards its enlarged role as Sector Developer, and suggested that NCSS should continue to be attentive to emerging needs and to be close to the ground.
  • Some members expressed surprise at the need for legislative change, given that NCSS was “already playing these roles”, and noted that in many ways, the legislation which focuses primarily on NCSS as a membership body was “catching up” with reality.

NCSS Board Composition

  • Most members agreed with the rationale for a more nimble Board and the proposed longer Board term for stability and continuity.
  • Most members understood the considerations for, and supported, appointments to the Board as a way to bring in relevant skillsets and to ensure diversity and representation.
  • Some members were concerned with the perceived loss of a ‘voice’ with the removal of the election process, and requested clarity in the Board appointment processes to build confidence.
  • While most supported allowing SSA senior management to sit on the NCSS Board, acknowledging that they would bring ground understanding and knowledge, some raised concerns about potential conflict of interest. Others suggested that they could sit on sub-committees to contribute their experience and expertise.

NCSS Membership

  • Some members questioned the need for NCSS to retain its Membership function, given that NCSS would be working with all sector players as Sector Developer.
  • Others felt that NCSS membership status acted as a valuable trustmark and provided a valuable platform for networking and community building.
  • Members questioned the definition of ‘direct service’ provider as a condition for membership, and suggested that the criteria be extended to ‘indirect service’ providers, who would also be able to contribute significantly to the sector.

We thank you for your participation and valuable feedback at the sessions. The NCSS Act review is a work in progress, and we continue to welcome feedback from all NCSS members. The draft Bill will be tabled in Parliament in 2025.
